Assessing Health Care Patent Infringement Claims

Analysis Group was retained by plaintiffs to assess the validity of patent claims (the scope of protection granted by a patent) allegedly infringed upon by defendants in their attempt to market a generic version of the plaintiffs' drug. At issue was the validity of the statistical analysis of the clinical data used by the defendants to support the claims in their patent application. Our team, led by President Pierre Cremieux, and including Managing Principal Lisa Pinheiro, Principal Jimmy Royer, and Vice Presidents Rebeccah Filsoof and Marissa Ginn, replicated the statistical analysis used to support the patent-at-issue and applied other, complementary statistical analyses that addressed the defendants' allegations of flaws in the original study methodology, thereby confirming the patent claims.
